St. Paul Man Waives Preliminary Hearing

On Monday, May 7, 2012, Dusty Dugan of St. Paul, NE waived his right to a preliminary hearing in Nance County Court in Fullerton, NE. He was bound over to District Court on one count of Selling Cattle Without Bill of Sale or Power of Attorney, a Class III Felony and one count of Theft of Livestock valued over $1,500.00, a Class III Felony. Dugan was also charged with one count, Leaving the Nebraska Brand Inspection Area Without Brand Inspection, a Class II Misdemeanor.

These charges stem from an incident on February 3, 2012 where Dusty Dugan allegedly hauled cattle from Howard County, NE inside the Nebraska Brand Inspection Area to Fullerton Livestock Market in Nance County, NE, located outside the boundaries of the Inspection Area without first having the cattle brand inspected for ownership. Allegedly, these cattle were owned by Steve Kirkland of Ft. Worth, Texas and Dugan consigned these cattle into the market in his wife's name, Lesley Dugan. Court records indicate that Mr. Kirkland was told that these cattle were missing or had died. Dusty Dugan's arraignment in Nance County District Court in Fullerton, NE has been set for June 1, 2012.
